These Terms of Use (“Terms”) govern your access to and use of edgex11.com (the “Site”), operated by EdgeX11 (“EdgeX11”, “we”, “us”). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
What these Terms do and don’t cover
These Terms cover this marketing website only. Your use of the EdgeX11 product at console.edgex11.com is governed by a separate agreement between EdgeX11 and your organization. Nothing on this Site is an offer, a commitment, or a contract to supply the product.
1. Eligibility
The Site is intended for business users aged 16 or over. By using it, you confirm that you meet that requirement and that, where you act on behalf of an organization, you have authority to do so.
2. Use of the Site
We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and view the Site for your own informational and business evaluation purposes. All other rights are reserved.
3. Acceptable use
You agree not to:
- use the Site in breach of any applicable law or regulation;
- attempt to gain unauthorized access to the Site, our systems, or any related infrastructure;
- probe, scan, or test the vulnerability of the Site except under our responsible disclosure process;
- interfere with or disrupt the Site, or impose an unreasonable load on it;
- misuse any submission mechanism — for example sending spam, malware, phishing content, or automated bulk submissions through the contact form;
- scrape, harvest, or systematically extract content or data from the Site by automated means, except for search engine indexing that respects our robots.txt;
- use the Site or its content to develop, train, or benchmark a competing product;
- impersonate any person or misrepresent your affiliation with any person or organization;
- remove, obscure, or alter any proprietary notice on the Site.
We may suspend or block access to the Site for anyone who breaches this section.
4. Submissions and feedback
Information you submit through the Site is handled as described in our Privacy Policy. Please do not send confidential, sensitive, or proprietary information through the contact form or by email — we cannot treat it as confidential and we do not want to receive it. By submitting, you agree that we may contact you about your enquiry.
If you send us ideas, suggestions, or feedback about EdgeX11, you grant us a perpetual, worldwide, irrevocable, royalty-free licence to use and incorporate it without obligation or compensation to you. This does not give us any rights to your confidential information or intellectual property beyond the feedback itself.
5. Intellectual property
The Site and its content — including text, graphics, layout, code, logos, and the EdgeX11 name and marks — are owned by EdgeX11 or its licensors and are protected by copyright, trade mark, and other laws. You may not copy, reproduce, republish, distribute, or create derivative works from them without our prior written permission, except that you may quote short extracts with clear attribution and a link back to the source page.
Third-party names and marks referred to on the Site, including in our comparison pages, are the property of their respective owners. We use them for identification and comparative purposes only, and their use does not imply affiliation with or endorsement by those owners.
6. Forward-looking statements and product descriptions
The Site describes EdgeX11’s product, roadmap, and compliance programs as they stand at the date shown above. Features, plans, pricing, and availability may change, and anything described as “in progress” — including certification programs — is not a representation that it is complete. Nothing on the Site should be relied on as a commitment to deliver any particular functionality, timeline, or certification. Contractual commitments are made only in a signed agreement.
7. Pricing information
Plan and pricing information on the Site is provided for general guidance, is stated in US dollars unless otherwise indicated, and excludes taxes unless stated. It may change at any time. The pricing that applies to you is the pricing shown in the product at the time you subscribe, or the pricing in your signed agreement.
8. Third-party links and services
The Site links to third-party services, including the EdgeX11 product console and our profiles on LinkedIn and X. We do not control those services and are not responsible for their content, availability, or practices. Their own terms and privacy policies apply to your use of them.
9. No professional advice
Content on the Site, including our blog, is provided for general information. It is not legal, security, compliance, financial, or other professional advice, and you should not rely on it as a substitute for advice from a qualified professional who knows your circumstances.
10. Availability
We aim to keep the Site available but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Site at any time without notice or liability.
11. Disclaimer of warranties
The Site and its content are provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement. We do not warrant that the Site will be uninterrupted, timely, error-free, or free of harmful components, or that the information on it is complete or current. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
12. Limitation of liability
To the fullest extent permitted by law, EdgeX11 and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or relating to your use of, or inability to use, the Site — whether based in contract, tort, negligence, strict liability, or any other theory, and whether or not we were advised of the possibility.
To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the Site will not exceed one hundred US dollars (US$100).
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.
13. Indemnity
You agree to indemnify and hold EdgeX11 harmless from any claim, demand, loss, or expense (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Site, or your violation of any law or the rights of a third party.
14. Governing law
EdgeX11’s operating entity and place of establishment are being finalised. Until this section names a specific governing law and forum, any dispute arising out of or relating to the Site will be governed by the laws applicable at EdgeX11’s principal place of business at the time the dispute arises, without regard to conflict-of-laws rules. This does not deprive you of the protection of any mandatory law of your country of residence, and it does not affect the terms of any signed agreement covering the EdgeX11 product, which will state its own governing law.
15. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date above always reflects the current version, and continued use of the Site after changes take effect constitutes acceptance of the revised Terms. If you do not agree with a change, stop using the Site.
16. General
- Severability — if any provision is held unenforceable, the rest remains in effect and the unenforceable provision is modified to the minimum extent needed to make it enforceable.
- No waiver — our failure to enforce a provision is not a waiver of our right to enforce it later.
- Assignment — you may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of assets.
- Entire agreement — together with the Privacy Policy, these Terms are the entire agreement between you and us regarding the Site.
- No third-party rights — these Terms do not create rights for anyone who is not a party to them.
